Terms of Services

Effective date: October 16, 2026

Welcome to ICEWAVE. These Terms of Service (the “Terms”) apply to your use of icewavetech.com and purchases from our store. In these Terms, “ICEWAVE,” “we,” “us,” and “our” mean Icewave Technology Limited, trading as ICEWAVE. Our website, store, content, features, tools, and related services are referred to as the “Services.” Our store is hosted on Shopify.

We currently accept orders for delivery only to eligible U.S. destinations described in our Shipping Policy. Purchases are also subject to our Return & Refund Policy and One-Year Limited Warranty. Please read these Terms and the applicable policies before ordering. By using the Services or placing an order, you agree to the applicable Terms. Our Privacy Policy explains how personal information is handled; it is not a request for blanket consent to every type of data processing.

Nothing in these Terms excludes or limits a consumer right or remedy that cannot lawfully be excluded or limited. New versions do not retrospectively reduce rights or more favorable valid promises applicable to an existing order.

1. Access and accounts

To place an order, you must be of legal age and legally able to enter into the purchase contract. Provide accurate and current information reasonably needed to process your order, including your contact, payment, billing, and delivery details, and ensure you are authorized to provide and use that information.

If you create an account, keep your credentials secure and contact us promptly if you believe someone has accessed it without authorization. You may not sell or transfer your account to another person. Your responsibility for account activity remains subject to applicable law.

2. Product information

We aim to keep product descriptions, specifications, images, prices, and availability accurate. Screen settings can affect how colors and appearance are displayed. This does not limit our obligations concerning a product’s description, quality, or conformity with the accepted order.

We may update information, discontinue products, or set reasonable purchase limits for future orders. A material change to an accepted order will not be imposed on you without your agreement. Later website edits do not retrospectively reduce the rights or promises applicable to an existing order.

3. Orders and acceptance

When you place an order, you make an offer to purchase. Your order is accepted when ICEWAVE confirms acceptance. Before acceptance, we may decline an order for a legitimate reason, such as unavailable stock, an ineligible delivery destination, suspected fraud, or an inability to process payment. We will contact you if we decline or cancel an order, using the details you provide.

If we identify a material error that prevents us from fulfilling an order as accepted, we will contact you to offer appropriate options, including a full refund if the order is cancelled. If we have taken payment for an order we do not accept or fulfil, we will return the amount due without undue delay and within any applicable legal deadline. This does not remove any other remedy available under applicable law.

Cancellation and address-change requests are handled under Section 5 and our Shipping Policy. Returns and exchanges are handled under Section 7 and our Return & Refund Policy, without limiting your non-waivable legal rights.

4. Prices, promotions, and payment

The price and applicable charges for your order are shown before payment. Applicable sales tax, if any, is shown at checkout. Free standard shipping applies to eligible orders as described in our Shipping Policy. We do not add undisclosed charges after an order is accepted.

Prices, discounts, and availability may change for future orders. Prices may differ from those offered by other sellers. Any additional promotion conditions will be stated with the promotion and do not override non-waivable rights or the terms already accepted for an existing order.

You must be authorized to use your selected payment method and agree to pay the amount confirmed for your order. Keep your contact and billing information current so we can process the transaction and contact you about it.

5. Shipping, delivery, and cancellation

Our Shipping Policy explains eligible destinations, order processing, estimated transit times, tracking, cancellation requests, and delivery problems. There is no 60-minute cancellation limit. Contact us as soon as possible if you wish to cancel or change an address. Before warehouse processing begins, we can cancel an unshipped order without a cancellation fee. After processing begins, we will try to stop or update the shipment, but cannot guarantee a successful interception.

Carrier handover does not automatically release us from delivery obligations imposed by law or our policies. We will investigate reported loss, damage, incomplete delivery, or an incorrectly supplied item and arrange an appropriate remedy. A carrier’s “delivered” status does not automatically prevent us from reviewing a report that a package was not received.

If we cannot ship within the stated timeframe, we will notify you and offer the choices required by applicable law, including cancellation and a full refund where required. Our ordinary cancellation process does not limit your rights concerning delayed shipment.

6. Intellectual property

Except for content submitted by customers or otherwise identified, the website’s text, images, graphics, videos, branding, and design are owned by ICEWAVE or used with permission from their respective owners. These materials are protected by applicable intellectual property laws. Customer reviews and other submitted content are addressed in Section 11.

You may browse the Services and use their normal features for lawful purposes. Except where permitted by law or expressly authorized, you may not reproduce, distribute, sell, modify, or commercially exploit protected material without the relevant owner’s permission. These Terms do not restrict fair use or another use permitted by applicable law.

ICEWAVE, Shopify, and other names or logos appearing on the Services remain the trademarks of their respective owners. No permission to use a trademark beyond lawful use is granted by these Terms.

7. Returns, refunds, and exchanges

Our Return & Refund Policy provides a 30-calendar-day return request window after delivery and explains return authorization, condition requirements, shipping costs, exchanges, and any supported deduction for actual loss in value. These voluntary return conditions do not limit rights concerning defective or incorrectly supplied products or any non-waivable remedy.

We will inspect an authorized return and issue the applicable refund to the original payment method within 72 calendar hours after our authorized return warehouse receives it. This includes weekends and holidays; inspection is included in the deadline. Bank or payment-provider posting time is additional. Where no return is required, the refund does not depend on warehouse receipt and must be handled within the applicable legal deadline and any shorter commitment we make to you.

8. One-year limited warranty

Our One-Year Limited Warranty covers qualifying defects in materials and workmanship for the entire unit for one year from actual delivery, under normal use in accordance with the product instructions. No separate 3–10-year core-component warranty is offered for new orders under these Terms.

The warranty explains coverage, remedies, exclusions, and how to request service. It is additional to applicable legal rights. It does not shorten non-waivable statutory protection or remove more favorable valid warranty promises already applicable to an earlier order.

9. Optional tools and third-party links

The Services may make third-party tools available or contain links to third-party websites. Those providers may have their own terms and privacy practices. Review the relevant information before using a separate service or submitting information to another provider. A link does not by itself mean that we endorse every statement or offering on that website.

We do not control independent third-party websites or all aspects of their services. This does not excuse our own obligations concerning your purchase, our handling of your information, or any responsibility imposed on us by applicable law. Questions about an independent provider’s service may be directed to that provider; questions about your ICEWAVE order may always be sent to us.

10. Shopify and privacy

Your purchases from this store are made directly with Icewave Technology Limited. Shopify hosts the store and provides related technology. We remain responsible for our obligations as the seller. These Terms do not release Shopify or another provider from liability that cannot lawfully be excluded.

Our Privacy Policy describes our collection, use, and disclosure of personal information and how to contact us about privacy rights. Depending on the services involved, Shopify may process information on our behalf or for purposes for which it is independently responsible. You can review Shopify’s Consumer Privacy Policy for its own processing.

The Privacy Policy controls if there is a conflict with these Terms about our handling of personal information. Where a particular choice or consent is required by law, agreeing to these Terms does not replace it. Our Your Privacy Choices page provides information about available privacy choices.

11. Reviews and feedback

You retain ownership of content you submit. You grant us a non-exclusive license to host, display, reproduce, and format that content as reasonably needed to operate and promote the store, subject to applicable law and the purpose for which the content was submitted.

We will not change a review’s meaning or remove it merely because it is negative. We may moderate content for reasons such as fraud, spam, threats, unlawful material, or disclosure of another person’s private information. We do not require you to transfer ownership of your reviews or waive the right to provide an honest review.

Submit content you are entitled to share, do not impersonate someone else, and disclose any material incentive or relationship relevant to a review as required by law. Do not submit malware or another person’s private information without a lawful basis. We do not promise payment for unsolicited ideas or feedback unless separately agreed.

12. Errors and corrections

We may correct typographical errors or inaccurate information about products, prices, promotions, or availability. For an accepted order, any material error or proposed change will be handled under Sections 2 and 3. A website correction does not permit us to keep payment for an order we cancel or to remove your existing legal rights.

13. Prohibited uses

You may use the Services only for lawful purposes. You must not commit fraud, impersonate another person, knowingly supply false transaction information, threaten or unlawfully harass others, infringe another person’s rights, distribute malware or spam, obtain personal information without authorization, or interfere with another user’s lawful access.

You must not bypass security or authorization measures, gain unauthorized access, or use scraping, extraction, or automated tools to disrupt the Services or evade access restrictions. Automated Agents that comply with Section 14 are excepted from any general restriction on automated access, but must still comply with the other restrictions in these Terms. Nothing in this Section prohibits an honest review or the lawful exercise of a consumer right.

14. Automated Agents

14.1. An “Agent” is software or a service that takes autonomous or semi-autonomous action on someone’s behalf when accessing or interacting with the Services.

14.2. An Agent may access the Services only while identifying itself, complying with Section 14.4 and any applicable access restrictions, and acting with the necessary authority. An Agent must stop accessing the Services if we request it to do so.

14.3. We may use technical measures to limit whether or how Agents access the Services, including to protect security, performance, and other users.

14.4. An Agent must:

  1. Identify itself in HTTP/HTTPS requests by including “Agent/[agent name]” in the user-agent string.
  2. Not conceal that it is an Agent, impersonate a human, or complete or circumvent a CAPTCHA intended to distinguish human access from automated access.
  3. Respond truthfully to a request to identify whether the interaction is from a human or a computer.
  4. Not bypass or evade measures that block, limit, or control Agent access.

15. Access restrictions and termination

We may restrict or end access where reasonably necessary to address fraud, security risks, unlawful activity, or a material breach of these Terms. Doing so does not cancel refund obligations, a valid warranty claim, or rights relating to an existing order. We will give any notice required by applicable law.

Provisions concerning existing orders, intellectual property, privacy, submitted content, lawful liability, disputes, and other matters that by their nature continue after access ends remain applicable to the extent permitted by law. Ending access does not permit us to retain payment for unfulfilled obligations without a lawful basis.

16. Website availability and product warranties

We do not guarantee that the website will always be available or free of interruption. Any disclaimer about website availability does not disclaim our express product promises, our written warranty, or any implied warranty or other protection that cannot lawfully be excluded.

17. Limitations of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, gross negligence or willful misconduct, or any liability or consumer remedy that cannot lawfully be excluded or limited. This includes product-related liability to the extent that applicable law does not permit a limitation.

Subject to the preceding paragraph and only to the extent permitted by applicable law, our aggregate liability for a claim relating to a purchased product is limited to the amount paid for the product giving rise to that claim. This limit does not reduce a refund, repair, replacement, or other remedy we expressly promise in our policies. Some states do not allow certain exclusions or limitations of damages, so a limitation may not apply to you.

18. Unlawful use and third-party claims

You must not knowingly misuse the website in a manner that infringes another person’s rights or violates applicable law. To the extent permitted by law, you are responsible for third-party claims caused by your own unlawful conduct or material breach of these Terms. This does not require a consumer to indemnify us for ordinary browsing, an honest review, our own conduct, or the exercise of a legal right.

19. Severability

If a provision is found unlawful or unenforceable, the remaining provisions continue to apply to the extent permitted by law. This Section does not make an otherwise unlawful restriction on your rights enforceable.

20. Waiver and the agreement

A failure to exercise a contractual right on one occasion does not, by itself, waive that right on another occasion. Any waiver remains subject to applicable law.

These Terms, the applicable linked policies, and the terms confirmed for your order form the agreement concerning the Services and that order. This does not cancel our express product promises, non-waivable legal rights, or more favorable valid terms already applicable to an existing order. Interpretation is subject to applicable law; these Terms do not require every ambiguity to be resolved in our favor.

21. Assignment

We may transfer these Terms as part of a legitimate business reorganization only where doing so does not materially reduce your rights or the performance owed to you. Any transfer remains subject to applicable law and any notice or consent it requires. An assignment may not be used to remove a consumer’s non-waivable rights.

22. Governing law and disputes

These Terms are governed by the laws of the Hong Kong SAR, except to the extent that applicable mandatory consumer law, including that of your U.S. state, provides otherwise. This choice does not deprive you of protections or access to courts available under applicable law. We do not require binding arbitration or a waiver of class-action rights under these Terms.

Please contact support@icewavetech.com to raise a concern. Contacting us does not replace or suspend any statutory deadline.

23. Headings

Headings are included for convenience and do not change the meaning of these Terms. Any language or interpretation rights provided by applicable law remain available to you.

24. Updates

We may update these Terms for future use and orders, with the updated date shown on this page. We will provide notice and obtain agreement where required by applicable law. A material change will not retrospectively reduce rights relating to an existing order. More favorable valid promises already applicable to an earlier order remain in effect for that order.
